Can an Employee Be Terminated While on Medical Leave?

Jason works at a construction company. His job requires him to be physically active all day, including operating heavy machinery. One weekend Ahmed goes mountain biking, crashes into a tree, and breaks both his legs. While he is recovering and using a wheelchair, Ahmed is temporarily unable to do his job at the construction company. Thanks to the Family and Medical Leave Act (FMLA), Jason takes 12 weeks of unpaid leave to get healthy before returning to his job. Two days into Jason’s leave, his boss decides to fire him because of his injury and inability to work. In response, Jason sues his employer for wrongful termination.
