Yes California AB-5 ABC Test apply to government employer-employee, and public entities. However, many provisions of the Labor Code and most sections of the IWC Wage Orders do not apply to public employees. (See, e.g., Johnson v. Arvin-Edison Water Storage District (2009) 174 Cal.App.4th 729.) AB 5 does not change that.
