Is a business license necessary in California?
In California the state does not issue or require a business operating license. However, to operate a company in the state, it may still be necessary to obtain a business license. This is because the majority of business licensing is handled at the city or county level. The licensing at the state level is only the seller’s permit. The general rule, with a few exceptions, is that an entrepreneur will need to obtain a business license to operate in the state of California.
When is a business license needed in California?
In the majority of cities and counties in California, companies are required to obtain a business license for tax reasons. There are exceptions to this general rule, though they mainly apply to unincorporated parts of rural counties. As well as obtaining a local business operating license, a business owner will also need to get other permits and licenses according to the kind of activity their business is doing or the specific place where they are operating.
For instance, if a business is located in many counties or cities, an owner will need to obtain a business license for the main location and then obtain business licenses in the other counties and cities where the business operates.
What are the different kinds of business licenses?
Just about every business will have to obtain a business license or permit of some mind before it can operate legally in California. It can unfortunately be difficult to know precisely what kind of license is needed to operate in a region or in a specific industry. Much is dependent on the type of business an entrepreneur runs. HE or she may need to obtain business licenses at the county, local, state, or federal level. Happily, the state of California makes the process a smidge simpler by providing a tool on the CalGold website, which allows a business owner to search by county or city, as well as business type, to study what permits may be needed as well as what regulatory agencies provide them.
Business licenses at the local level
The generic kind of business license that an entrepreneur will require is known as the business operating license. This is known simply as a general license or a business license, and it also usually includes a business tax certificate. This kind of business license is the most common and applies to almost every kind of business. It will be almost identical in all counties and cities across California.
A business owner may need to obtain a business license pertaining to their company name. If the name an entrepreneur is doing business under is not the same as the name the business was registered under with the Secretary of State, it may be necessary to get a Doing Business As (DBA) or Fictitious Business Name (FBN) statement.
A business owner will also need to obtain a business license related to public health in certain circumstances. If a business is a coffee shop, restaurant, fitness facility, or other public health business, the owner will need to obtain a public health operating license. Cooks, chefs, servers, and baristas will also need to obtain a business license known as a food handlers’ certification. This allows them to work in the industry. This kind of permit typically demands some kind of testing or training.
A business owner will also need to obtain a business license related to agriculture if they operate in that industry. Specifically, they will have to get a pesticide applicator’s license if they use any form of pesticide. This may demand passing an exam.
Further local permits
A business owner may need to obtain business licenses specific to a county or city. In California, these may include the following:
- Land use and zoning permit: This kind of permit is required if the land you establish your business on it not correctly zoned for the kind of business you are operating.
- Building permits: If an entrepreneur is constructing a new building or repairing an existing structure, they will need to obtain a building permit.
- Fire department permits: If a business utilizes flammable materials and faces the public, as is the case with gyms, restaurants, retirement homes, daycares, and hotels, this kind of permit may be required.
These permits are different than business licenses. Still, it is important that you research them to see if you need to get one prior to opening your company.
Licenses on the state level
Some business licenses in California are controlled on the state level rather than on the local level. The sales and use permit is the most common one of these, often referred to as a seller’s permit. A business leasing or selling any tangible property needs to obtain a seller’s permit prior to making the first sale.
If a business manufactures, sells, distributes, or imports alcoholic beverages, the owner must apply for the mandated licenses with the California Department of Alcoholic Beverage Control. They must also register with the Department of Tax and Fee Administration to pay an Alcoholic Beverage Tax.
It is possible a business owner will need to obtain business licenses related to other subjects if they intend to operate their business in California. To check which are applicable, a business owner should conduct additional research using the CalGold website.
Permits and licenses on the federal level
The majority of small businesses will not have to obtain a business license on the federal level. However, depending on the activities a company conducts or its size, it may be necessary to obtain a business license on the federal level. Typical business areas where you may need to obtain a business license or permit on the federal level include:
- Alcoholic serving, sales, importing, or distribution
- Agriculture
- Aviation
- Wildlife and fish
- Ammunition, firearms, and explosives
- Maritime transportation
- Commercial fisheries
- Drilling and mining
- Radio and television broadcasting
- Nuclear energy
- Transportation
What do you need to do to obtain a business license in California?
Step 1: Form and name the company
To obtain a business license in California, the first step involves forming and naming your company if you have not done so already. After you have begun your business, be sure to have the key details in order and prepared for opening an application. To do this, you will require:
- A name for the business
- An SSN (for sole proprietors) or an EIN (Employer Identification Number)
- An entity type for the business (partnership, LLC, corporation, etc.)
- A business phone number and address
- A business plan that includes anticipated expenses and revenue
- COI for the business insurance policy
Step 2: Obtain a business license in California
After you have collected the required information, you will have to obtain a business license in California or a business tax certificate in your county or city.

Take a look at your city’s website for information on beginning the process. If you live in an unincorporated region, look at your county’s website and begin filling out the relevant forms.
Step 3: Figure out what additional local licenses are needed
With the help of CalGold.ca.gov, you can figure out what additional licenses on the state or local level are relevant to your business. There you may submit the necessary information to obtain business licenses.
Step 4: Apply for further state business licenses
If you company is selling or renting tangible goods, you may require a seller’s permit, which is handled on a state level. However, the local county may also control it. To obtain a liquor license, you will need to apply on the state level.
Step 5: Apply for federal tax treatment and licenses (if required)
While the federal government does not issue or require general business operating licenses, you may need to obtain a business license with certain government agencies according to the industry. Common industries that demand federal permits include fishing, firearms, farming, transportation, and alcohol sales.
What is the cost of a California business license?
A standard business operating license in California varies in cost according to the locality. Some cities do not charge small businesses for licenses. On the lower end, a business owner can anticipate a charge of $15 to $30. On the high end, the cost may be several hundred dollars. This fee is repeated every year or few years when the owner renews the business license.
A business owner may also be charged a percentage of their number of employees and annual revenue rather than being charged a flat fee. This is typical for bigger businesses. Smaller businesses, by contrast, are only charged a flat fee. It is possible that franchise taxes will be levied as well, but this is separate from business licensing costs.
Do business licenses need to be renewed in California?
Every California agency handles business licenses differently, but most mandate that business licenses be renewed every year or few years. If you are unsure, be sure to contact the agency from which you received your business license.
